Hi,
My parents got their second Re-entry Permit approved (applied through Application I-131) in first week of Jan 2008. This rentry permit is valid for 2 years (i.e. till Jan 2010). They had applied for the second Re-entry Permit on 16th Feb 2007. And after applying it they left 19th Feb 2007.
They are planning to return to US in Jan 2010 before the Re-entry Permit expiration. I read on this and other forums that with Re-entry Permit a US resident can live outside for more than 1 year and less than 2 years.
In my parent's case, when they will return back to US in Jan 2010, they will already have spend 3 years outside US.
I was concerned that the 2 year stay limit will be counted from the day my parents left US or the day when the Re-entry Permit got approved?
Secondly, Is there any limit on number of times a Re-Entry Permit can be applied?

1. Copy of I-797 of H1 visa holder.
2. Passport copy of H1 visa holder.
3. Recent pay stubs of H1 visa holder.
3. Marriage Certificate.
Am I missing something.

Not sure you need any of 2, 3 or 4. However, it is very helpful to have a letter from the H1 employer saying that you are still employed by your company or whatever you work for and your spouse is currently on an H4 dependents visa.
My husband has found this has been adequate on many occasions.

He is a former Goa, India tourism minister Francisco Xavier �Mickky� Pacheco was caught on the backfoot on Sunday once again as reports surfaced that the US State Department�s Bureau of Diplomatic Security had informed India that Mr Pacheco might be involved in a big immigration and money laundering racket.
Mr Pacheco used to operate an employment agency along with his estranged wife Sara Pacheco which specialized in finding employment for Goans abroad. But according to the former minister, he has had nothing to do with the agency since he separated from his wife around four years back.

I need advice/thoughts from you on some of the questions below. Any response will be really appreciated.
1. Got my 485 approval and GC (phycical Card) in hand. What is next? Do I need to get a Infopass appointment and get stamped before any abroad travel?
2. Before receiving 485 approval, my wife and kid went on a Vacation(abroad). Their H4 visa expired on passport, but they have h4 extension/approval till 2010? I was thinking of sending them to H4 stamping, but now that I have 485 approval for them, What should I do? Just bring them here and show GC at port of entry? (Ofcourse, I'll take their GC go abroad and bring them back)?

You can re-file a denied I-140. In my case, first I-140 was denied in 2006 but never received the denial notice, so time for appeal lapsed. However, during 2007 July, we concurrently filed using the same labor. The second I-140 was approved in 2009. Both the I-140s were processed by Nebraska Service Center.
Hence, based on my experience, you can refile but you should be able to over come or at least have strong enough reasons to over come the cause of initial denial.
I am not sure on how to deal with with-drawl of your existing appeal and 485 petitions.
As far as 180 day rule of labor is concerned, my understanding is that, based on USCIS clarification, it only applies to initial filing of I-140 petition but not for re-filing as long as the original I-140 was filed with in permitted time. You can go through websites of Murthy / Rajiv Khanna for authentic information on this.

No difference. You pay more for 1 yr textensions as you have to do 3 times as compared to 3yr extension. No lawyer will advise you to go for 1 yr if you have an approved I140....

I have appied EAD and AP together for me and my wife.
I didn't receive the receipt notice for my wife EAD but the check is in cashed. when my wife called TEXAS center, IO told it was rejected by mistake and reprocessed.
She will call again tomorrow to find more. Her online status is still, petition is not signed and rejected. Application mailed back. But I didn't get the any document in mail.

how is it possible to change jobs while the GC application is pending (part of the July 07 madness). Supposedly there is the AC21 form, is there an example how this form should be filled, and what other documents should be included? How long does it take to approve? (for driver's license, traveling, etc.). Does it have to be filed with H1B extension?
The new job offer is 25% pay increase, otherwise very similar, could that be a problem?
It depends on what your status is and which stage of the immigration process you are stuck in.........
As the other member pointed out, you could ask the attorney - IV holds these calls free every week...

The United States Immigration and Customs Enforcement (ICE) recently updated their list of Student and Exchange Visitor Program (SEVP) approved schools (http://www.ice.gov/doclib/sevis/pdf/ApprovedSchools.pdf) .
The schools listed have all been certified to participate in the program. The program allows foreign students interested in obtaining an education in the United States to complete a visa petition, pay the required fee, and attend a U.S. College or University. The Department of Homeland Security (DHS) created a web based system called the Student Exchange Visitor System (SEVIS) which maintains information on the foreign students accepted into the program. The SEVIS monitors the students for the duration of their approved stay, as required by the Illegal Immigration Reform and Immigrant Responsibility Act (IIRAIRA) of 1996.
Interested Foreign students: There is a process in obtaining a student visa, but it is not a difficult one. The student must first obtain Form I-20 from the U.S. College or University from which he/she intends to enroll, pay the required visa fee (Form I-901) and contact a local U.S. Consulate/Embassy to schedule an interview. At the interview, the student must have Form I-20, proof of payment of Form I-901, financial support documentation, and a completed visa application. The SEVP procedures differ among U.S. Consulates/Embassies; contact your U.S. Consulate/Embassy NOW to determine its particular procedure on applying for a visa before planning for the interview.
Interested Schools: There is a separate process to obtain F & M Certification. Authorized school officials must obtain and complete Form I-17. Once your 290B is approved, your 485 goes back to pending status from denial and 485 is related to your priority date. When is that?
