Guys any suggestions? How long does it take to produce the cards these days? I've seen many approvals where they get the cards within days. Pretty confused about this.

Is there any way that we can get the USCIS to update their Aug 2007 bulletin and write on top of it and the July bulletin was valid till Aug 17th.
That way any officer who would check the Aug 2007 bulletin would first see the update and go by the July bulletin instead of rejecting I-485's in a bunch which cause additional hardships to the applicant in getting it reopened via MTR and again going through the long process.

You can say 'Yes', but it will trigger unnecessary questions from IO. I am not sure about the consequences. If I were you, I would say NO as its not full time course and not going to change the status to F1. I beleive you should say 'YES' only if you change to F1 visa in the future.

User,
You need only AOS receipt, when you travel outside
So dont worry about EAD and AP receipts as you will get EAD Card and AP Doc directly to your address
So just ask AOS receipt saying you are planning for travel

Yes. First I-140 should be cleared for you to port your PD to the second I-140.
I struggled a lot with this stupid PD transfer. Hope this helps.

Hi,
I do not see any EB3 alone approvals (with no porting). Can people please update here if there are any EB3 485 Approvals so that we can get some pattern out of it.
Appreicate your response EB3 guys..

Thanks for replying back. I dont think we would need a change in legislaturel for USCIS to start accepting i-485 applications, when the PD's are not current. I'm sure there must be a way we are just not thinking differently. If we were talking about getting the GC, then yes we would need a change in the legislative process via or bill and so the hopes from CIR. Currently EAD does not mandate a need to prove an employer-employee relationship during renewal or issuance as in the case of a H-1B application.

Hi,
My I-485 currently pending which was filed based on Approved I-140 (employment based).
My sister also had filed I-130 (Petition for Relative) on my behalf, whose priority date has become current
in last Aug 2009.
My Attorney had sent letter to USCIS requesting to Transfer my pending AOS from Employment to Family based,
(AOS Interfilling) in november 2009. She sent another letter in Jan 2010.
I called USCIS three times to find out the status on my application. My attorney has also called two times.
There is no change in my status at all, the USCIS don't even confirm that they have received any letter for
Interfiling my application.
They tell me to call the service center where the letter was sent. Is this possible ?
When my Attorney sent the AOS Interfilling Letter, She did not send I-864 (Affidavit of Support)
with the Letter. When I Asked her, she said as per parson's memo only the letter is required. Is she correct ?
If anybody has similar case, please advise me.
I don't know what to do ??? Should I wait for the response from USCIS ? , should I Change the Attorney
or Should I take Infopass Appointment.
It has already been four months since my attorney has sent letter, and I don't see any progress from USCIS.
someone plase help me.
Thanks

Thanks for your reply. In this specific skills or requirements, we also listed several tools, I let my former employer listed them in their experience letter. Other than that, I really don't how to proof them.
on 2nd req, my opinion would be to submit following related to ur skills.
- certifications earned from industry recognised bodies like PMP or OCP etc.
- any inhouse training recd certificates
- any vendor recd training certificates

Does any one know how a company from a foreign country(India) can open a bank account in USA.
There is a possibility to register as a company in US and then apply for business account. But being still on H1 dont feel comfortable to register a company in US.
Are there any other ways a company in foreign country can open an account in USA to do the business at least to get the payments from the US customers.
Are there any suggestions to specific banks like wells fargo or so that would help in the process?
How about credit unions like DCU? Do they offer such provisions?
Any thoughts on this would be greatly appreciated..

Hi,
I filed my 485 on July 5, 2007 at NSC and got my receipt number yesterday. I sent my wifes 485/765/131 on July 24, 2007 to NSC. She is on H4 currently. TOday i got my wifes receipt numbers for all 3. But to my surprise the receipt numbers were given by TSC instead of NSC.
FYI my 140 is pending with NSC.
I am just wondering if this will be a problem? Any one had been through similar situation?
Thanks in Advance!!
You should be happy for this as I am still waiting for my wife's EAD from NSC

I called the embassy and the staff member told me that I would have to go to the nearby DHL office in LIMA and drop all the documents. And then the embassy would get back wihin 4-10 business days.
This is really dicey for me since the Christams holidays could push this ahead.
So no go.

Hi,
I am currently on h1b visa without a project from past 1 year in US and my employer asked me to convert to L2 visa dependent on my husband who is on L1 visa . I do not have any paystubs for my stamping. If I go to canada consulate for stamping, what is the success rate for my visa being approved? Will I be able to come back to US without any issues. Also, can you suggest me to which consulate should I go for my stamping? Please help!
Thanks.
If you didnot receive pay for 1 year means you were illegal in USA. This site is for highly skilled Legal immigrants. you can file a complaint against ur empoyer for not paying wage once you are on L2. If you win case against ur employer keep record with u and go for l2 stamping .. you should not have any issue.
Note : I am not an attorney. This is my view and can be differ from other.

6. Implications for Certain Employment-
Based Second and Third Categories
Absent legislation providing for additional visa numbers,
the Ombudsman estimates that some individuals under the
India category in the Visa Bulletin now may wait at least 10
years to complete immigration processing and obtain a green
card. This estimate assumes maximum annual preference category
and per country usage. If these projections are correct,
affected individuals will spend many years of their working
lives as applicants for green cards, i.e., as neither temporary
workers nor lawful permanent residents.
Looks like stage is set. People already in queue as of 07/2009 have 10 years and no one new can apply for next 10years

Thank you for replying. One more follow up question: Is acting without pay considered work and hence a violation ? Thanks in advance.
Yes, acting without pay is working. You might not receive a benefit in financial terms, but you are getting other benefits - experience, publicity, etc.

I am currently employed by a company A on H1B. I applied for a I-140 substitution and I-485 concurrently through company B and my I-140 is not approved yet. Now the company B is forcing me to leave my current job with company A and join them.
Is there a legal binding to join the company ? Can I join the company after my I-140 gets approved ? Please help.

I feel bad for you. Given that nobody has responded to you yet, i am guessing not many are experiencing similar problems.
Try the following:
1) Talk to your lawyer and see if contacting your local congress person would help you.
2) Post in other forums as well such as murthy.com and immigrationportal.com.
Good luck. The whole GC process is very stressful when everything is progressing without a hitch. So, I cannot imagine how much more stressful it must be when things get screwed by BEC and/or USCIS.
