Hi all, apologies first off for not knowing all the technical USCIS lingo, but my question is relatively simple.
Situation: I am a US Citizen and I'm planning to marry a non-US Citizen in October. He is from India, currently on H1B, has the EAD, and is now patiently waiting. I don't know his priority date offhand, but I do know that he applied during all the crazy hubbub that happened in July-August 2007. (wow, it's been almost 2 years? time flies!)
Our marriage is totally legit, we've been for 5 years, living together, etc. What we need to know is, would it be better to forget the work-sponsored GC application and go for a family one? Or can he have applications for both at the same time? Would changing to a different type of application affect his ability to continue working at his current job, at all?

H1 and H4 are 2 different classes.

I have to attend for H1 visa renewal...means I got extended H1 handy and All I have to do is get it stamped in chennai...
I was under the impression that i'm gonna take my wife along with me by adding another application to the selected date/time slot of mine....which they recommend in general..
if h1 and h4 belongs to two different classes how can I tie them together when selecting another applicant after filling those online 156 and 157's?
any thoughts?..
I'm sure many of the folks here wld have coem across this scenario as it invloves H4 - H1 stamping stuff...
can someone pls advise me...thanx in advance...

I'm off to London for my H1B stamping. I was working for an Investment Bank that folded and I took up a job with a bank that has not taken TARP funds (not a US bank)
My I-129 was approved, however, it was approved before the new I-129 that asks whether the company accessed covered funds.
I just wanted to know whether I need to ask counsel in my firm to update the I-129 or should I just go ahead with the stamping?
Any other important documents I should take along? I was thinking of
a) letter from employer stating salary, start-date, position etc
b) letter from company stating that they did not receive TARP
anyone else on the same boat?

... and ideally it should be copy of your approved labor.
I applied my labor as Software Engineer and BEC approved it with a code of Mechanical Engineer. I got it changed, but took me a year though. They kept my change request until the end when they were ready to shutdown BEC.
I probably go ahead and use what in the approved labor certificate. by the way how do I find exact job-code that I used in the I-140.

Does anybody have idea or experience how long it takes for USCIS to make desicion about I-485 expedition (pending for 2.8 years now)?

Why isn't IV a national member of the Reform Immigration for America Campaign? If you take a look at the list of participating organizations Organizations � Reform Immigration For America (http://reformimmigrationforamerica.org/about/organizations/) you'll only see that the TX state chapter has signed on. Core group, could one of you take a look and sign-up? Would IV consider cooridnating events with them during 2010?

Hi,
Regarding A# on I 140, if you've missed that in your 485 application, it's no big deal as long as you've sent a copy of your I-140 approval notice that has the A# mentioned in it.

Submit all your I-94. How does it matter?? Once u leave US, u cannot enter on any of those I-94 anyway.

Remember, you are signing each and every form. Which means you are certifying the following: "I certify, under penalty of perjury under the laws of the United States of America, that this application and the evidence submitted with it is all true and correct."
So when a form asks for your address, it HAS to be YOUR address. Providing any other address would be illegal. Tell your employer he/she cannot force you to commit perjury.

I am a US Citizen who applied through I-130 form for my married daughter since 2001. She and her husband came here with a tourist visa in 2003 and they overstayed it for a period of 6 years. In the meatime, they had 2 americam kids. They are still in the USA.
I am starting to receiving document from NVC to pay $70 for Affidavit of Support for their cases. I would like to know if an Adjustment of Status can be made for them here in the USA as the immigration does not know where they are right now. I presumed also that they can't return back to their country of origin cause they've been here for so long that they could get caught and get penalized. They have never been employed but received support from the family members and their kids received welfare aids.
What can be done if I want to Adjust their status here? Thank you already for your answers.

Check with your international students office. In our time, they needed to sign the I-20 before you/your wife can leave the country. I also think she needs a separate I-20 with a F2 endorsement. She should not just carry your I-20 with her name in it, then you are supposed travel with her. Again, these were the old rules and I am not an attorney and this is not a legal advise, just from my personal experience.
this only applies if your spouse does not have any other visa. In the Op's case, she already has a 10 year visa, so she is okay to visit. Just make sure that you are able to show the necessary funds for support when she lands here.
