Hi Everyone,
I did not get back any responses. So I am posting it again. Can someone please advice?
My PD is EB2March 2005.
My position titles are not same though the job is similar.
My salary is 35% more
Please advice if it is too risky to file for AC21
There has been many discussions about AC21. Please search for them and read.
If you have a job in same/similar you should be OK.
There is no form or application to fill. Some prefer to inform USCIS but not a requirement.
With your priority date, why don't you wait for end of this fiscal year to see if your GC gets approved.

You could travel out and enter into US using your old visa stamp assuming that you enter before your old visa stamp expires. However show the new approved I-797 H1B petition at port of entry and they MOSTLY will give you a new I-94 valid till the expiration of new I-797 approval.
That's wonderful news and thank you for that. Is there a benefit of getting a 1-94 upto the extended date, does 1-94 determine the visa validity not the actual visa stamp? Since I-94 is taken when exiting US the next entry requires visa stamp anyway?

I had ask these questions on the attorney calls few months ago and this is what i got from it.
The questions are:
1. Can I file an extension of H1 with pending MTR and with less than year old labor application?
- No, need to have approved I140 in your case.
2. Is it legal to stay in US after May 2011 while MTR is pending and H1 extension is filed before expiry?
- Cannot file H1 extension with that
3. In case, if the MTR is denied, would the illegal/out of status will start from 15th May 2011 or from the date the MTR is denied?
- i think yes.
Please consult a lawyer to get reliable answers/second opinion.

Buddy, you will need to send only one AR-11 but will need to call in your change of address for every application. One phone call will cover it all, but make sure you tell the Customer service person that you needed this to be changed for every case. Then you will get a confirmation letter at your mailing address for every case that you changed address on. That is what I had to do on my 485 and EAD application.
Also if you have any dependents over 21 (like spouse) then make sure your spouse is next to you or calls in separately to the Customer service. They will not allow you to speak for your spouse. You could do so for dependents under 21 though.
Here is the little official quote and the link:
If you are not a U.S. citizen and you have a case pending with USCIS you need to do both - call customer service and complete the Form AR-11. The AR-11 is used by non-U.S. citizens to meet the legal requirements of informing USCIS of any change of address. Presently, completing an AR-11 does not update your address on any pending case. Also, while calling customer service updates the address on your pending case, it does not meet the legal requirement of completing an AR-11.

The EAD and AP should go to the same service center as your I-485 application. The address will be listed on your I-485 receipt notice. Pretty straight forward, you can do it yourself, do not pay a lawyer for preparing these documents. Good luck.

I have a friend in India who applied to a new H1B through a consultant, was lucky to get through the lottery but is now stuck in RFE because of issues with the consultant. He heard from someone else that the same consultant is getting rejects and is nervous that his case will get rejected too.
I've heard that while a H1B case is pending (before it is denied), one can apply a separate petition from another employer and is still considered a valid application that is within the quota as it is for the same applicant.
Does anyone have experience in this area? What do you recommend? I also plan to contact an attorney regarding this to help my friend.

Hello, I am on H1B with an employer with dates from sep 2005 to sep 2008. I am amending my petition (with a new lca) as well as extending it for the same company. The amendment date will be from April 1st.
Now my question is shd my extension (with amendment) be from April 2008 to April 2011 or can it be for the remainder of 6 years that is April 2011 to Sep 2011. Please let me know. Thanks
