FYI...Anybody who has an appointment for a Visa stamping on Oct 1st at the U.S Consulate in Chennai, India, please contact the VFS office (91-44-4231-6767) to find out your new date of appointment (which the Consulate says, will be in the same week), if they have not intimated you by email already.

All,
We know we have our largest membership in CA. Well over a hundred members. Yet there are only about 10 active members. And yes, these 10 are extraordinarily dynamic, but we need more. In particular we need more members in SoCal.
Those of you who have already signed up as volunteers -- please attend the weekly call this Thursday at 9pm PST. Once you are on the call, please speak up, take the initiative and work on something.
Respond to the weekly emails.
- Convince at least one more person to become a member
- Convince at least one more person to contribute
- Post our flyers in your neighborhood or workplace
- Come up with other ways to get the word out
- Join a lawmaker team
- Start a lawmaker team and make an appointment

We recently assisted a client from Johannesburg, South Africa, regarding an H-1B specialty occupation visa. He was approved for an H-1B visa, but in order for our client to enter the United States, he must obtain an H-1B visa in his passport. Because the chances of visa issuance vary greatly depending on documentation and individual circumstances, we suggested that he go to the interview at the U.S. consulate very well prepared. We told him to take a certified copy of his entire H-1B package that was filed with the Immigration Service, along with his Form I-797 Approval Notice. We also suggested that he take original birth certificates, marriage certificate, and proof of financial support. He attended the interview this morning and his experience at the U.S. consulate in Johannesburg, South Africa was documented as follows.
“My wife, myself and our son had our interview at the U.S. Consulate here in Johannesburg this morning, at 9:00am. We duly arrived at 8:30am, had our relevant DS documents checked at the door, took a number, and waited for the “call.” At promptly 9:00am we were called to a booth, where our fingerprints were taken, the DS forms checked with the original I-797 form, and then told to go and sit down again. 10 minutes later, we went back to the booth, had our fingerprints taken again, and that was it. Hello all:
First, I'd like to express my thanks to IV for taking up this cause and doing a wonderful job!
I am currently on an H1-B visa. My 6 year term expires 2/1/09. Current employer is yet to file LCA. Company lawyers have advised that any time I've spent out of the country (past & within next few months) can be used to offset the 1-yr cut off requirement for LCA application. I've been out for a total of 6 weeks to date, but would need more time, looking at an April-end LCA filing. I am now looking to change my job.
-Can I change my status to H4 until I get another job and then file for GC with new employer?
-What are current processing times for H4 if applied from within the US?
-Will I get subjected to H1 quota when changing back from H4 to H1?
-I've been told time spent on H4 is not counted for H1 term and I can apply that time (in addition to my 6 weeks) to the 1-yr limit (LCA should be filed 1 yr before 6-year H1 expiration). Is this true?
-If so, what about the time taken for H4 approval? Can I be in status after resigning & while waiting for H4 approval? Can the time taken for H4 approval be counted towards time not on an H1?
-Has anyone heard of such a situation? What are the chances of getting an extension if H1 ported to new company & LCA filed with them after joining?

I am also facing a similar situation. My lawyer advised me not to worry about this.

A friend of mine is a citizen from a non Visa-waiver country, married to an American. They've been married for two years and she is expected to receive her green card in a few months at the embassy of her country of origin where she still lives. Because of abuse issues, she wants to separate asap but is afraid he might retaliate by trying to prevent her from receiving her green card. Is that possible, or should she wait until she has the Green Card in her hands? Thanks!

My H1 Extension approved from Sept'2010 - Dec 2012. LCA shows same dates and the salary shown is $5500 PM ($66000 P.A)
However recently, i noticed that i am receiving $5373(instead of $5500) per month since Sept'2010 till date.
I informed to my employer and he is willing to increase the pay from March.
Is it possible to correct it from March payroll.
Please advise.

The employer should correct it from March and pay the 6 months difference as bonus. At end of year your salary should be at least equal to LCA.

1. When can i expect my EAD ?
2. Is there any rule that i shud start working within some stipulated time after getting my EAD or i can take my own time ?
1. it should take another week or 10 days...
2. you could start when you want....

I94: The number should be same for all. You need a copy of most recent one. Although, layers have been taking copies of all I94s. To be on safer side, you can send copies of all I94s.
AP: You can travel on valid AP. Return before it expires.
Renewd AP: It will have new valid dates. When you get this (in USA) then you can use it for travel. I am not sure whether it is OK or not OK to tell friend to mail it in your country of visit and try to come back on this.

I and the lawyer studio failed the first request for a VISA. I didn't like their way to work and all the money they asked ( 12000 USD for nothing) so I am looking for alternatives.

You can continue both. Company B cannot tell you to do withdraw other 485. Infact you shouldn't have told company B about 485 with company A unless your company B was willing to use AC21 to continue your GC process. Now they have reason to believe you might leave them for company A.

If I transfer my H1-B now to another company, then do I automatically get another 3 years or do I have to file an extension after my H1-B has been transferred?

My job description is "xxx mathematician" on the I-140, but what I'm actually doing is developing and supporting scientific programs. The industry is not IT. If I switch back to IT, could it still be "similar job"?

since your I-485 was filed with old fee you will have to file the appropriate fee with AP application as well as EAD each time you renew it.
Everyone who was eligible to file under July bulleting will use that fee. $305
From Faq2 published by USCIS.
Q21: Will USCIS permit applicants who filed adjustment applications between July 2, 2007 – July 17, 2007, but who have not yet received a USCIS generated receipt notice, to file for Advance Parole and Employment Authorization based on proof of delivery of the I-485 application?

You ignore that part as it is not applicable to you. You either fill up part 6 or 7
