Dear All:
Details: Indian, in H1-B status. Current visa stamp in passport expires in mid July but employer is applying for the extension.
The situation: I want to quit my job late this summer and relocating to Asia. Before I leave this continent, I'd like to travel around South America and maybe even do some volunteer work. I'd love to travel for at least 1 and maybe even 2 months.
Ideally, I would like to re-enter the US after this trip and collect my bags before flying to India.
What are my options for re-entering?
1) Get new H1-B stamp in passport before quitting the job (though this would be kind of a pain/expense). Quit the job, ask the company not to cancel the visa and re-enter the US after the trip on the new H1 stamp. I am guessing this is a somewhat risky option as I would technically be out of status, right?
2) How hard would it be to switch to a tourist visa and get a new stamp in a country like say Argentina or Mexico?
What do you think my best option is or am I out of luck?

May be it is worth it or may be not....In www.cnn.com there is a section (on the left hand side) asking what the democrats should do first. (They are basically asking our opinion)
I wrote down some items that I thought they should discuss, namely, in the area of legal immigration relief for EB categories.

First of all Congrats! to all people who are eligible to file 485 in july..
i have strage problem..i am not weather its a problem or not..i have filed my GC in 2004 December and you all know that after that the BEC process came in every thing went to BEC's..and i had no hope on that file and i asked my employer to process my GC under PERM process in 2006 april and i got the Labor and I-140 approved in 6 months...and mean while i got the 2004 labor approved in Feb 2007 and asked my employer which one will be the best and he recommended me apply for I-140 for 2004 labor and wait untill the dates become current and he was expecting the 2004 will become current...so we have applied for I-140 for 2004 labor on May 1st 2007 and the status is pending...now my questios is..
1) Is there is any problem if i use the 2004 labor and apply for I-485.
2) When attorney file for I-140 did they mention any where in that forms that i do not have any immigration petiton has been submited before?
3) If they mention no (miss communication) and applied for I-140 for 2004 labor but in fact there is a petition (I-140) submited for me for my 2006 labor.will this be a problem for my 485 approval?
4) which one will be the best for me to use now 2004 or 2006?
5) I spoke to my attorney on this and he said as long as you have not filed for 485 for 2006 labor then there is no harm.But i am concernet about that if my attorney (2004 labor) mentioned that i have not submited any immigartion petition when he filed for I-140,which is not correct since i have appled for I-140 for 2006 labor will that be a problem for my I-485 process?

My company prepared for my PERM filing in EB2 category. They did all recruitement efforts. But at the time of filing, company annouced some lay-offs as "restructuring". Now my lawyer says, it is their policy not to file for PERM before six months of any lay -offs since some lay -offs involve same job title as my labor supposed to be filed. Since this is my lawyer's policy, My question is, is it safe to file PERM right now? What if I use different job title then the one my lawyer used before for recruitement efforts. I found some new information and it seems that few people who are still waiting may get some clue if not complete idea. Basically I found that when your PD is current the the IO will initiate the FP, Namecheck, IBIS check again when your AOS is in "Final Approval, Visa Available" state. Some IOs would just refresh the FP they have on file and some request another . But namecheck is something that you have to go through again. So if you get stuck in namecheck again, then that could be the reason for the delay since NC takes forever.

im currently living in NJ and my i-140 was approved.. since im on EB3 and my priority date is on 4/2008 i still have some time to wait in order for a visa to be eligible to me..
my main concern is : i would like to know if its possible for me to obtain a driver license with the approval notice i received from USCIS (i -797c Notice of action).. does my employer will need to fill out any forms for for that to happen ?? if so, what kind of forms :(
any help is appreciated..

My husband has a pending I-130 visa petition (I am a US citizen, he's Italian, we live in Italy). Can anyone tell me whether he is permitted to enter (and exit, as we are still residents in Italy) the US on holiday (departure 19 dec)?
