AFAIK, Once you have a receipt number for 485, your 485 application will either be denied/approved. If approved, you will get your GC as a visa number has bee set aside. I 140 premium processing doesnt help you to get the GC by the end of the month.
talk to your lawyer to get the correct info about what happens with your 485 application with the retrogression of Schdeule A.

It's just bad luck to get that kind of CBP officer. It's upto you to ignore this or escalate it. In my opinion behaviour of CBP officer was wrong.

I have followed it up with AILF and 3 more attorneys just in case to see if a law suit is feasible. All of them said, it is not possible. Only option left is to write to Dept. of Justice to see if this law holds a constitutional test. I wrote once, but never got any reply on that.
But if we could take this as a group and mobilise on a mass scale to reach out to DOJ and have them review this INA law we might get attention.
Couple of points to Nay sayers.. that this is not racial descrimination

I do not know what level of education you have achieved so far in your life but it looks like you are not enough educated to differentiate between the definitions of permanent residency, citizenship and perhaps working on work visa as far as legal stay in USA by outsider is concerned.
What would be the "legal" reply from US Supreme court,if you ask US supreme court that whether citizen of other country can call US president a "My president"? . And What would be the "legal" reply from Supreme court of country A,if you ask that whether citizen of country A can call US president a "his/her president"?
USA expects someone to abide by the land of the law while s/he come to US to work legally. And what is expected legally is one is not involved in "Anti USA" activity whatsoever it may be.USA legally never expects citizen of other country "to love" or "show fidelity" towards USA when s/he is still the citizen of other country.

Nothing more or less is legally expected by USA and employment system within USA. USA and its whole society is well aware that these persons are citizen of other countries and so they never expects any kind of fidelity from them at least "legally" and at the same time they even do not grant the rights what US citizen nornmally have. Now out of that bunch many people prefer to go for permanent residency as permanent residency bring little bit stability in living and flexibility in employment and international travel. If one becomes a permanent resident of USA then also USA still only expects that person abide by the law of the land and do not involve in "anti USA" activity. It still does not expect "fidelity" towards USA in legal sense.There is no legal or social or political or any kind of pressure from USA or any governmental or non governmental institutes within USA on any particular person coming from other country to become its citizen. One can stay on permanent residency forever till death(At least based on current prevalent law) and legally work and s/he does not have to become a citizen for working legally. And I do not know about other countries but in India it is not considered "illegal" and/or "unpatriotic" to go in other country(Except Pakistan and Bangladesh) for legal work so coming to USA for legal work whether on work visa or becoming a permanent resident in USA while maintaining Indian citizenship simultaneously is not unpatriotic or illegal. Simultaneously USA's legal system allows an Indian to remain as citizen of India while residing in USA permanently for legal work.
Now if somebody decides to become a US citizen, there is nothing wrong in that. I do not see anything wrong when rsharma states that "I have decided to become US citizen in future". But if he is mature and human enough then his fidelity at this moment should be towards India (Assuming he is a citizen of India currently) as he is a citizen of India at this moment. Showing this kind of behaviour perhaps may not be a outright unpatriotic in terms of "Indianness" but it certanily signals probable but strong disloyality towards India.
And I do not think that USA citizens are that naive that they consider the people "not mingled" if citizen of other country do not call USA president a "My president" while holding the citizenship of other country.
If calling US president a "My President" by non citizens would be the barometer of "mixing" / "mingling" then USA would not be today's USA. So please do not kid USA and us .

The poor response is because we are not together and we truly do not believe in our goal. Arunmohan, this is exactly what I have been doing. Contacting local congressman and senator, but in vain. I agree with you that they respond, but it doesn't transfer to results. What I believe should be done, irrespective of EB2, EB3 etc are these following steps.
1) Local chapters prepare a letter to their local congressman and senators asking them to process gc backlogs in the order of labor filing date by USCIS. This is applicable to EB3 / EB2 / EB1 of any country. In respective categories GC with Pending I-485 applications should be processed by labor filing dates.
2) Conduct a month-long drive to make members visit a place nearby their residence to sign and fill their details along with the letter.
3) Send Original letter along with signatures to senator & copies to congressman/congresswoman.
4) Send copy of the same letter to the chapter nearest to washington d.c. and we should forward that copy to the president's office.
I know this sounds a lot. But this will be a co-ordinated effort & i am sure if we give members a month to sign, majority will be included and will be a co-ordinated effort from iv. but this is just my thought.

The NSC july 2nd filers are speculated to be transfered to TSC almost 2 months down the line and no one has guaranted that our Original Receipt date of July 2nd be kept intact - How do you logically map this ??

So I think 3 years is intelligent guess. But who knows I am just trying to make myself happy and trying to stay positive.

Remember Indian Economy's engine is outsourcing, once it starts to see the $ exchange pressure, forget about people coming to US, think of what will happen to standard of lving in Inida.
Can India still maintain the new glow with dollar coming down , I doubt as the Govt of India has not made any big steps to make permanent changes to infrastructure set up.
More Mc Donalds, Pizza Huts, Starbucks, Wal Marts will come up in addition to Coke and Pepsi and also mor eand more American companies will come there and pick up the money.
