I have been following IV ever since itz inception and I really appreciate all the efforts by volunters.
However, I feel we have up-hill battle in this current political and economical situation and we need to re-think about startergies and solving current retrogession.
I just want initiate brainstorm, I am not sure if these ideas are discussed before,
Having seen how CIR bill is killed in House, I am very doubtfull about SKILL bill getting passed in house.
getting any pro-immigration (legal/illegal) is a long processes, so can we need to focus on what we can do to reduce the retrogression within current legal framework
like
lobby senators to enforce USICS on following
- Reduce time taken for Security Checks
- Try to consider 245i cases in a different catagory than EB3
- Try recapture unused visa numbers from 2003-04-05
- issue EAD/AP for three years
- remvoe per country quota
- allow to apply for I485 if I140 is approved, ( I know this is controvesial but we can try)
These simple things could reduce retrogression if not completly resolved

1. Did you also enter on H1b and then switched using EAD?
---When i filed the EAD renewal i was still on H1B. Just filed EAD as a backup.
2. So do you have H1B on 'Last entry status' and 'AOS pending' on 'Current status' questions?

Hi,
I know your time is very precious and not to waste.
My issue is - I came to US as a programmar/analyst in Aug' 2005 with my B.Commerce (3years) and Master of Computer Applications (completed my 3years masters by 2003) in India. My H1 company in March'2008 applied for PERM/I 140 through EB3 (as a professional) recently they came back to me that my I140 got denied because of educational evaluation comparison difference and need to reapply again through a new lawyer as EB3 - unskilled - system support engineer.
Is this really require to go through the new lawyer to restart the GC process? - and this costs me to lose my priority date - almost 2 years
If yes, how are the chances to get the perm/I140 if I reapply through the same H1 company ?
remember that I have to go for H1 extension by Aug'10 ( as I complete 5 years on my H1).
Kindly suggest.

Yes one must be a Greencard holder to attain unemployment benifits.

You do not require valid visa stamp to go India. If your kids are US citizen, you will need PIO card for them. While travelling back from India, you will be asked for valid Visa or AP to board fight for US from Frankfurt.
Our visa stamp (H1B/H4) are expired in our passports. We are planning to travel via 'Frankfurt (FRA), Germany' to Mumbai in Lufthansa airlines and we will get our passport .....................

When I did it in Delhi at US embassy there was an officer at the embassy counter just before entering into the embassy when you are at the line outside with your papers, he checks your documents. For me he checked my papers and wrote on them " PIMS found". After that i went into the embassy to get into the another line to talk to officer inside.
Though it was 3 years back I am not sure if its done the same way now also.

I played around with this a bit, and found the solution. The problem occurred when I had "Empty Project." I created a new project "Console Application," and then I was able to "load" the Process class/namespace. Can anyone explain to me why this would happen? I did a few searches online, but didn't find much help...
Those who have been using C# for a while, what type of project do you mostly choose that are NOT GUI?

You can transfer your status from H1 to F1 using a "change of status" form. The main issue is getting the F1 visa stamp. In the visa application form, there is a question which asks whether anybody has filed an immigrant petition on your behalf. As I-140 has been applied/approved, you will have to answer yes for that question. This will show immigrant-intent: but F1 visa is strictly non-immigrant intent - you have to show that you are not planning to stay in US. <--- You will have issues proving this.
I don't think that you will have any issues if you don't go for visa stamp and stay in US during the duration of your studies.

Hi:
I have H1b renewed on the basis of pending AOS application (EB3 june04) till 2012 and also ead/ap based on my spouse's AOS application. I am going to India on a vacation soon for a month or two. Recently I have heard many horror stories that even stamped H1B is getting rejected in POE. My question is that if something like that happen to me at the POE can I invoke my unused EAD/AP and request entry based on that? The reason I don't want to simply go back is because I have a house here in USA and a mortgage that I continue to be paying to keep the house.

Never heard of anyone with proper papers getting into trouble (ie. the H1 is for a valid job, and in your case (where you are returning to continue employment) you have recent paystubs etc.
There were some rumors about people working for some body-shopping companies getting into trouble because they did not know who the client was, and what work they would do.
Check with a lawyer for the second part of your question, though my understanding is that you can still request to be admitted based on the pending 485 filed on your spouses job. The only kink is if your H1 entrance is denied because they suspect fraud, then I dont know how it plays out on the AP/EAD.

I forgot to mention one thing..my h1 was done by an university ...in 2002 when this quota was not there....just because its done by an university..I cannot assume it came under a non quota-exempt...since this was done when the quota system was not in existence...
