I am shocked too. 2 members who I called on phone were abusive. They started blaming Aman Kapoor saying that he is rubbing his idealogies over already stressed immigrants - this was ridiculous and I am so sad that people have such thoughts.
If people are scared or want to live in Shadows why abuse IV who are truly committed for a cause???? These are the same people writing rubbish on those threads that ran 200 pages when they were waiting for USCIS announcement.

This is a problem because the DL people do not understand the immigration law. I was in a similar situation 2 years ago in Iowa. Tried to explain to the manager of the office, but got a lecture on how good their public transport system is. Then I went to another DL office in a rural county. The counter clerk refused, asked to see the supervisor who agreed to extend for 6 months by which time my extension came through.

Remember in life you have to have an attitude of respecting others, if u think you need to be treated specially cause you have lived in America 10yrs then u would be definitely disappointed. A lot of my friends have relocated to India and I am too early next year. The only answer is attitude.
But there are cases where you expect to be treated like a human , and you are not. That is the most difficult thing for some who returned and regret doing so.
And it is a bigger dream (than dream about getting GC) to expect people to leave en masse .

This is not good. My PERM labor is stuck in Atlanta, I was hoping to apply I-140 pp since my 6th year H1 is expiring Dec, 07. If I can get my I-140 approved then I'll have to leave.
1. If your labor was filed in Nov 06 or earlier then you can file for 7th year extension (based on rule that labor pending for more than 365 days)
2. I'm not 100% sure but i think when your labor is approved if PDs are current, you can file i-140, 485, EAD together and get EAD by before your visa expires and you would be fine.
3. Labor substitution will not be allowed after July 17th, and there are a lot approved labors whose beneficiaries have left the company. Employers are willing to use these labors for whatever they get (excuse me!). If you really want to stay in US, find an approved labor with PD older than Nov 06 and then file I140/485/EAD, if you don't get EAD by Dec 07 then file 7th year ext based on the GC pending more than 365 days. But if you're on travel and questioned by immigration upon entrance if you're still working for sponsoring employer, depending on the circumstances, they can take your GC away. So that's another scenario separate from an audit or citrizenship interview that GC jeopardy may arise.
Didn't think about that. but... why would officer ask "do you work for the sponsoring employer"? Isn't your GC same as family based, asylum, etc. green cards? Does officer even have that information right away? What do they ask usually?
If circumstances change, like you getting laid off or fired, that's a different story. If the sponsor's intent changes, and that does happen, then obviously, you're free to move on. But you should be able to prove that, with say a termination letter, for example.
I don't see the difference between being laid off and leaving yourself. In case of being laid off, your employer has to show intent of employing you forever. If any document will surface, that he had plans to lay you off before applying for I-140 or without you invoking AC21 at moment of AOS, then you are in the same trouble.
All the way one keeps thinking that you are free to start a business, look for more exciting opportunities, go work in starbacuks...( yeah all that )...once you get a GC..
But, now everyone is talking about again sticking to the sponsoring employer, a green card being revoked while entry...and umpteen scenarios...
So, where does it end..when can one really feel you can flex yourself and do something without worrying about my employment history...

Congrats to President Obama.
But, I don't personally agree with the selection committee's decision which suprised everybody including the President. The peace prize should go to someone who have had a track record for working towards achieving peace or the greater Good. They never gave one to M.K Gandhi who deserved it more than anybody in this world.
Make no mistake, Mr. Obama is a messenger of peace but, the fact is that he has been awarded prematurely for something he is yet to achieve in terms of ending the wars, ending nuclear armament, mid-east peace agreement etc (even though I think he will do so in the future).
The peace prize should not be an award for someone's intentions but for someone's actions that follow the intentions.

This whole discussion is really silly... I'm glad IV leadership is not self centered, atleast from what i see they think about the community on the whole.
Lets put all these fruitless arguments to rest... the ROW vs India/China, Nurses vs Others, EB1 vs EB2 vs EB3!
I'm EB3 India and I have no one to blame but me for being in EB3 (I'm certainly qualified to be in EB2 but I chose to stick around with the same company for the very reason we all are here on this forum... i.e GC)
For those who think its unfair... rather then sulking about it... do something and move to EB2 if you cant wait any longer... or at least support IV in their efforts.

Outlook is very very grim without a bill from what I understand. EB3 India is going to be in a hole and EB3 PDs that are 2006 and later have a really long wait time ahead that they are not imagining. We are all hopeful by nature and look forward to visa bulletins with a positive attitude but such PD folks may be disappointed month after month for several years. For EB2 India it is important to know number of ported cases. EB3ROW folks also need to worry now. Their journey may not be that smooth due to spillover rules and high demand. We need to get data via FOIA to make a better guesstimate. Without such data we will hear various theories, predictions and interpretations from various websites and blogs that may not be always true.

Even if you are an immigrant but as long as you are subject to the law of UnitedStates you have every right to fight discrimination and other actions that you percieve are illegal. Even Illegal immigrants can do that. It is there in one of the ammendments.

Recently I returned after a one month trip to India. At DC airport the CBP secondary inspection officer grilled us rough. First he called my wife and asked why did we leave US. She told that since my parents are old and not in good health we visited them. Then he started asking for documents proving it. And told us that without documents he won't let us enter. He went on to say that AP is only on humanitarian basis and unless CBP officer is satisfied with proof they cannot allow AP holder to enter. Finally after convincing him for another 30 min he let us in.
This was a really shocking experience. Are employment based GC's AP supposed to be treated like humanitarian AP? or was the CBP officer over reacting? Gurus please throw some light.

If you have a hypothetical 'Bernake tax' of 50 cents per barrel ( distilling to a few pennies per gallon) for one year, one could generate 1500 million dollars. This is without the troublesome IV members getting GC, problems with anti-immigrants in many states, employing more temps at CIS to process the extra 10,000 GC in the queue etc. While I claim not to be smarter than the Fed chairman, even if I am just a local politician, I will bet on taxing gas per barrel than give GC in an election year.

How about getting somebody who already got his green card, and after getting the card created jobs or did some inventions.
In such a case, we can definitely contact some of the desi CEO's etc. I am sure that they will be sympathetic to our case ??

This strategy worked for lot of folks. But there are some States like CO where no DMV office understands our problem - NJ is not like that at all.

My friend was in a similar situation last yr, He took his all his documents to Trenton DMV and they have given him 90 days extension.
Try that, Good Luck
Other Option is convert your H1 Extension to premium and get the approval before your H1 expiration date
