It's been about an year the case has been closed. I can't expunge it for 4 more years. The attorney said it may not be under CMT. I think even though we expunge it, in future where ever we go, if asked that ever got arrested, we need to say YES right?
My attorney says it should be OK.. I am not sure what to be done as you said it all depends on the VO

I wish they do the horizontal spill from other countries to India every quarter. This way the work load at the USCIS is steady. Instead they like to wait for the last 3 months. This does not give them enough time to process.

The baseline of my conversation goes as: there is limited funding, limited opportunities even for US born scientists, then is it wise to "import on permanent basis" scientists from abroad?Yes, it is good to have the best here, but what we (USA) require is education and training of US-born first ...
Take home message for us guys is this: These are the people the congress hears out first when they want to make policy changes. These are the people who were able to convince NIH to double its funding in 5 years time a couple of years back. These are the people who are now saying that there is no job and money for US-born, so first get more fundingand training for us citizens, before you get foreigners to carry out research ...

Next few months could be the only ***healthy*** window of time to achieve a remedy for retrogression. Not only the economy is driving anti-highskillimmigration groups more vocal, we are slowly finding the pro-immigrant support base thinning out because of very bad fiscal situations.

I-140 premium processing was stopped last year...It takes upto a year or more to get I-140 approved, that too if its a direct case...If its a interfiling case to capture PD from Eb-3 to Eb-2, then its taking even longer..One of my friends filed I-140 in March 2007 to capture his Eb-3 PD of Apr 2004 to EB-2 and he is still waiting....I-140 processing dates are well beyond his receipt date but still his application is pending....So porting PDs is not that straightforward these days...

this is my 10th year in the US & never had a single incident along the racial lines.. probably I lucked out.. However, I don't subscribe to this opinion of removing moustache..... I am proud of my bushy moustache & have had women admire that at/outside work.. But I do agree 100% on all the other points you raised..

If you were not told the correct bill rate, you can recover that money. Simply ask them in writing to show you the contract since you are on 70/30 basis. The written contracts, oral contracts, emails all stand in the court but how will you prove an oral contract? If you have found an offer that meets your expectations just quit. We all make the same mistakes. We spend our time on working out things where they are not working. Just "quietly" without your employer getting a hint, find a job and quit.

If I had my green card today, I would surely be making at least 15K more in my salary per annum repeat per annum.
If not all, many of you are in the similar situation.
My $200 contribution is just 1.33% of that lost opportunity per annum. If I take into consideration the 4 years of wait, it comes to 0.33%.
Almost anybody who is in US for 5 years on H1B can buy an nice little home. (Bay area is bit more cruel).
Last year I could have bought a home for say 500K. It would have surely appreciated by 50K. But because of the uncertainty of GC, I can not. That's a loss of opportunity of 50K.
My $200 contribution is just 0.4% of that another lost opportunity.
Now you know why I support this effort.
Most of you and your friends are in a situation similar as mine.
I urge you to become aware, make them aware and support this effort, which has a potential to minimize those lost financial opportunities, with your wallet.

although this doesn't fit 100% to your case. You may want to look at the attached administrative appeals office decision.
Essentially, a person was denied in eb2 because they had a 3 yr bsc and 2 year masters. they had education evaluationstating that masters indian degree was equal to us masters degree.
nebraska service center stated that 3+2 is not equal to masters degree. Admininstrative appeals office decision approved it saying that it didn't matter how long the combined study was. As long as foreign masters equals us masters then that is all which needs to be proven.
My experience has been that texas service center sends an rfe for this 3+2 education. I know of 8 cases where thie decision was shown in the rfe and they all 8 got approved. I know of one case in nebraska where this case was shown and they still denied it stating that it wasn't a precedent decision (person already had another 140 denied and there was some history in his case which i believe caused nebraska to deny it). Odd part was that the appeals office decision was from nebraska service center

Nancy Pelosi has long talked about her first 100 hour agenda and immigration is not on it. It would be amazing to see any immigration talk in lame-duck session.
Although, it would be a good start because both parties agree on it but I don't think the strategic think-tank in either party will rush to do that before seizing each other's deeper 2008 Presidential agenda.

often times i have noticed that the blissfully ignorant GC applicants come better off than rest of us- who act like chicken with the head cut off after every bad news!!! may be they dont worry too much and look at it from a whole another perspective...who knows...i wish i could be one of those, but i am too far in the game...damage is already done...:D

In my proposal, if I cannot get my greencard, then nobdy else should. This is more fair.:D

We all know, Priority Date is not used for prioritising approvals. It is just a date on your application, which can stop your application from progressing further, if looked at, at the wrong time. Why not simply ask for approving in PD order.

I have been a big fan of IV and have been a visitor to IV for a while. I now plan to become a volunteer and join my state chapter and also contribute in all possible ways to IV because I think IV is the best thing to happen to this community.
Dear gurus - here is my issue and I need some real concrete help.
I was working for a New Jersey based consulting company on a percentage basis ie 80/20 and all costs towards GC and h1b were by me. I found my own projects and negotiated my own billing rate.
I worked for this company for 3 years and filed for 485 in July 2007. I am EB2 India with a priority date of March 2nd, 2006. My 140 was approved in June, 2006.
In March, 2008 my project got over and I started looking for new projects. Market conditions forced me to take up a fulltime job using my EAD and I had to move into a fulltime job.
As it is safe past 180 days, I used AC21 portability and moved.
I had been having excellent relationship with my desi employer and in fact also payed up some money to the employer because the client did not pay for last 2 months of my project and my desi employer held me responsible as it was me who negotiated with the client and said it is my issue - for which I agreed.
I already sent a AC21 letter to USCIS through my Attorney - I am not sure if my file got updated.
My desi employer wants to withdraw the 140 petition now. He says, he cannot keep 140 petitions of employees who leave the organization and not on w2 and he will have "ability to pay issue"
I have heard horror stories of USCIS issuing denials and NOID because AC21 letter never reached the file even though it was sent in time and I guess this is exactly what my desi employer thinks - teach lesson by withdrawing 140.
I spoke to my Attorney and she says "your file may not be updated but we will keep a record that we sent" useful in case we want to respond to NOID or RFE.
Folks - please post your AC21 success/horror stories when previous employer withdrew the 140 petition.
What are my options to avoid a NOID or denial

I will just digest and summarise the interesting points:
For illegals who entered the USA before April 5, 2001...
Immediate Adjustment of Status after paying fines and any additional amounts
Must be employed for at least 3 years during the 5 year illegal presence
Employment requirement not applicable to those under 20 years of age
Employment requirement of 3 years can be reduced if proven physical or mental disability like pregnancy
Alien shall not be required to complete employment requirements with the same employer!
OK, I am not going to go on as I will leave the rest of the reading up to you all. But I need to ask this: "The adjustment of status" above... does this mean those illegals don't need to go thru LCA and I-140? Also, they don't even need to stay with the same employer at the time of applying for AOS....
Sounds like a very good deal for these people.
So could someone explain to me why we in the retrogression queue should accept this bill even if it increases H1B and promises to reduce backlogs for GC when illegals who have been here for more than 5 years (many of us also have been here that long) get special treatment? It's a really bad deal for us.
